TERMS AND CONDITIONS

Please carefully read the General Terms and Conditions on this page. They limit our liability and outline the terms and conditions under which your tour or hotel package will operate. Payment of deposit represents an acceptance by the traveler of the terms and conditions as stated here.
Reservation Deposits and Payments: A deposit of 20% of the total sum of travel package is required at the time of booking. Hotel bookings are subject to 100% advance payment. All reservations are subject to cancellation if payment is not received by the due date. For your convenience, check, money order, Discover Card, Master Card, Visa, and American Express are acceptable forms of payment. 

CHANGES BY YOU

If you wish to change your booking after it has been confirmed e.g. guest names, date changes, etc, you must cancel your booking and re-book through the Baku Travel Services website. We will try to assist but cannot guarantee to meet such requests. Cancellation charges may apply as set out in next clause. Reimbursement for unused accommodation cannot be made unless you have cancelled online in compliance with the next clause or in exceptional circumstances when hotel stay has been curtailed due to emergency. In these cases Baku Travel Services requires receipt from the hotel confirming this and may require additional documentation (such as medical certificates) prior to considering individual cases. The cost of any exchange rate differences resulting from your booking changes, will be the responsibility of the booker. Any claim must be presented to Baku Travel Services in writing within 30 days of check-out. 

CANCELLATION BY YOU

You may cancel your booking on-line in accordance with the hotel's cancellation policy. Your cancellation must be made through the Baku Travel Services website. Some cancellations or changes made out with the cancellation policy will be subject to a charge equivalent to the cost of the first night of accommodation. Any claim must be presented to Baku Travel Services in writing within 30 days of check-out. Please note that certain special hotel rates are non-changeable and non-refundable once the booking has been confirmed.

CHANGES OR CANCELLATION BY US

We reserve the right to make changes or cancellations after the booking at any time, although we will endeavour not to make a major change or cancel the booking within 72 hours of the arrival date, except by reason of force majeure (see clause below). If we have to make a major change to your arrangements after booking we will offer you the option of accepting the change or cancelling the booking and receiving a full refund of any monies paid to us. We do not accept responsibility for any expenses or costs you may incur as a result of any change. 

FORCE MAJEURE

We do not accept liability or pay compensation for any loss, damage or expense where the performance or prompt performance of our obligations is prevented or affected by reason of force majeure. Force Majeure means any event which we or the supplier of the service could not, even with all due care, foresee or avoid such as war or threat of war, riots, civil strife, terrorist activity, industrial action, natural or nuclear disaster, fire, adverse weather conditions, closure of airports or ports, technical problems with transport, governmental action and all other similar events. 

OUR LIABILITY TO YOU

(1) The published descriptions of hotels are given in good faith. Baku Travel Services does not accept responsibility for errors or omissions. Sometimes hoteliers may suddenly withdraw a facility temporarily or otherwise. This is beyond our control and we are unable to accept liability. 

(2) We accept responsibility for the proven acts and/or omissions of our employees, agents, suppliers and sub-contractors providing they were at the time carrying out work in the course of their employment or contract. We also accept responsibility if the services that we are contractually obliged to provide prove deficient or not of a reasonable standard. 

(3) Please note that the maximum amount we may have to pay you for any and all claims or parts of claims which do not involve personal injury, illness or death is limited to the price (excluding administration and cancellation fees) paid by or on behalf of the person(s) affected in total. 

(4) It is a condition of your contract that all claims are notified in accordance with clause 15 below. Where any payment is made to you, you will assign to ourselves or our insurers or the relevant supplier(s) or their insurers any rights you may have to pursue any third party for recovery of such payment. You must also provide all assistance reasonably required in connection with such recovery. 

HOTEL NOT HONORING BOOKINGS

At the time the booking is made, we issue a booking confirmation number and to the best of our knowledge at this time, the booking is valid. In the unlikely instance of the hotel failing to honor the booking then please refer to your booking confirmation and contact the us by e-mail or telephone number available at ‘contact us’ page. 

NON-ARRIVAL AT THE HOTEL

In case of late check-in at the hotel, your credit card details, given at time of booking, will guarantee your room in case of late arrival. However, if you are due to arrive after 6.00 pm, it is advisable to contact the hotel directly beforehand to advise of this. A contact number for the hotel n find on the corresponding hotels page of our web-site or hotel reservation confirmation sent to you after booking. Should you fail to arrive at the hotel on the arrival date the entire booking will be cancelled. The room will not be available on any subsequent nights of the booking and you will be charged the cost of the whole booking. Reimbursement for unused accommodation cannot be made unless you have cancelled online in compliance with clause above. 

MEDICAL PROBLEMS

If you have any medical problems or disability which may affect your stay you must advise us before booking giving full details to us. Your booking may be declined or cancelled in your best interests if your hotelier or we feel unable to properly accommodate your particular needs. 

PRICE CATEGORIES AND HOTEL STANDARDS

We segregate each hotel room as hotel describes itself . While Baku Travel Services takes care to ensure that the hotels are placed in a category that accurately reflects the property, it is the responsibility of the guest to ensure that the hotel they book represents a standard that matches their needs. You can access more detailed information about the hotel you are booking from the 'Hotel Description’ page during the booking process. 

ROOM PREFERENCES AND TYPES

Please pay special attention to the room description at the time of booking. We do not have any control over special requests to individual hotels, however, any special requests made at the time of booking will be passed to the hotel with your booking details. 

It is the responsibility of the person making the booking to ensure that the room(s) booked will be suitable for their party size. It should be noted that European or U.S. room types can differ greatly from Azeri one’s. Please check during the booking process for any additional supplements (i.e., single occupancy of twin room or 3rd adult sharing twin room) - these can be specified during the booking process. 

Hotels have different child policies and it is the responsibility of the person making the booking to check directly with the hotel for information such as the maximum child age and what discounts apply, if any. 

COMPLAINTS

In the unlikely event that you are disappointed with your hotel accommodation, you should contact the hotel who will try to solve the problem. The contractual obligation lies with the hotel in this instance. If after that you still feel that the problem has not been resolved to your reasonable satisfaction you should within 7 days of returning from the hotel put your comments in writing to us, and we will forward them to the hotelier.


Prices:
Prices quoted in this website are in effect at the time of printing and are subject to change without prior notice.
Change/Amendment Fee:
A handling fee of $50 per reservation/booking will be charged for any alterations or amendments made to a tour reservation after a written confirmation has been issued.
Tour Route Alterations:
Due to unexpected circumstance, schedule change, equipment failures, delays, charter s of the vessels, tour routes and day-to-day itineraries may be altered without notice. Baku Travel Services reserves the right to substitute itineraries, hotels or vessels without notice. In such case we will do everything we can to make sure the locations visited, the excursions taken and the hotels or vessels offered are similar to the ones originally planned. Any such alternations or substitutions of hotels or vessels will not affect the quality of the tour/cruise and will not result in eligibility for a cancellations or refund.
Hotels: Accommodations will be provided in hotels as listed in each itinerary. BTS also reserves the right to substitute hotels of a lesser category, in this case, an adjustment in the price will be made based on the differences between the actual net group rate paid by BTS after completion of the tour. 
Not Included in Tour Price:
Custom & Immigration fees, departure taxes, fuel surcharges & airport facility charges, domestic airfare, visa, passport fees, excess baggage charges, custom and security charges, items of a personal nature such as laundry, fax, telegraph and telephone expenses, room service, drinks, beverages, optional excursions are not included in the tour as well as other unforeseen personal expenses. Gratuities to tour directors, local guides and bus drivers are not included and are entirely at the participant's discretion.
Responsibility:
Baku Travel Services, Qara-Qarayev 81, 31, Baku, Azerbaijan (hereinafter referred to as the Tour Operator) is responsible for making the tours offered on this website. The responsibility of the Tour Operator and /or its representatives and/or its agents is limited. The Tour Operator acts only as an agent for the tour participants in all matters connected with the tour transportation, hotel & dining services, sightseeing tours, and other services, including all transportation whether by air, motor coach, rail, car, boat, or by any other means. The Tour Operator acts only on behalf hotels, airlines, bus companies and/or owners, operators or contractors (all hereinafter called Contractors) providing services in connection with these tours and all tickets, receipts, coupons and vouchers are issued subject to terms and conditions specified by these Contractors. As an agent, the Tour Operator holds itself free of responsibility for any damage, injury or loss resulting from any cause. By accepting the coupons and tickets, or utilizing the services, tour participants agree that neither the Tour Operator nor its representatives and/or agents shall be liable for any loss, or additional expense, injury, or damage to the tour participants or their belongings or otherwise in connection with any accommodation, transportation or other services, or resulting directly or indirectly from any other occurrences beyond the control of the Tour Operator, including breakdown in equipment, strikes, acts of god, fire, acts of quarantines, medical or customs regulations, delays, cancellations or changes in routing or sequence or alternation of sightseeing in itinerary or schedules, etc. The Tour Operator reserves the right to withdraw and/or cancel a tour or make changes in the itinerary whenever, in its sole judgment, if conditions warrant it, or if such cancellations and/or changes result from circumstances beyond the control of the Tour Operator, or it deems it necessary for the comfort, convenience of safety of the passengers. If the Tour Operator cancels the tour, it shall have no responsibility beyond the refund of all monies paid to the Tour Operator by the tour participant. The Tour Operator reserves the right to refuse or revoke travel to anyone who is, in the sole judgment of BTS, incapable of a group travel. If such person is asked to leave while the tour is in progress, that person will be responsible for any additional charges incurred by the departure from the tour or their return home. There will be no further obligation or liability on the part of the Tour Operator. The tour conditions become a binding contract when your enrollment and payment are received and accepted by Baku Travel Services.
